Neighbors sue to stop Breckenridge hotel and condo project

A homeowners’ association is seeking to stop one of Breckenridge’s largest developments, fearing it will block scenic views and threaten the structural integrity of its condos.

A lawsuit filed June 10 escalates months of tension between neighbors and Breckenridge Grand Vacations, a developer in the resort town. BGV is building the Imperial Hotel and Private Residences at 1599 Ski Hill Road, near the base of Peak 8 at Breckenridge Ski Resort.

The 400,000-square-foot project will have 133 condos, nine townhomes and a 36-unit hotel, plus restaurants, bars, theaters and office space for Vail Resorts. Permitting is planned for October and construction is expected to take 36 to 40 months, Summit Daily reports.

The idea has drawn criticisms from residents of One Ski Hill Place, a ski-in and ski-out condo building just to the west. They worry about increased traffic, decreased access to Breckenridge Ski Resort and a large dog park they expect will be both loud and smelly.

The condo owners met with BGV in early May to hash out concerns, then sent a letter to the Breckenridge Town Council on May 6 asking them not to approve the development.

“We went home on (May 2) thinking this is a done deal, and when I heard there were letters from One Ski Hill Place this morning, I thought they’d be letters of support,” BGV CEO Mike Dudick told the council May 6, according to Summit Daily’s reporting.

Dudick called it “a complete 180 and unexpected,” but Alexander Dorotik, an attorney for the One Ski Hill Place HOA, called Dudick’s remarks “nothing short of astonishing.” Dudick and BGV had reneged on their promise to do away with the dog park, he claimed.

A week later, the town council voted to approve the development, following the advice of a planning commission. So, on June 10, Dorotik sued on behalf of his HOA client.

The lawsuit asks Judge Reed Owens in Summit County to declare the town council’s approval null and void. It makes several claims: the council did not properly make a motion to approve it and did not allow for public comment, the proposed hotel’s height of 64.5 feet exceeds town limits and blocks One Ski Hill Place’s view corridor, and its density also exceeds limits for that area.

“The development of the Imperial Hotel (also) endangers the property rights of One Ski Hill Place HOA and the structural integrity of the One Ski Hill Place building, presenting a serious engineering and public safety concern,” according to this month’s lawsuit.

It remains to be seen whether the judge will recuse himself from the case. He is married to Mayor Kelly Owens and sometimes sits out lawsuits filed against Breckenridge.

A spokeswoman for the Town of Breckenridge, Flor Cruz, declined to comment on the case. A spokeswoman for Breckenridge Grand Vacations, Ginny Vietti, declined as well.
