Shuttered BBQ chain faces pair of lawsuits

The abrupt closure of a barbecue chain has left vendors hungry to get paid for overdue bills.

Southern Concepts Restaurant Groups Inc., which operated two Southern Hospitality barbecue restaurants – on 17th Street in Denver and at the Park Meadows Mall in Lone Tree – and a Carve Barbecue on Colorado Boulevard, was sued for $50,000 by food vendor Shamrock Foods Co. and $200,000 by landlord Unico.

Shamrock filed suit Aug. 10, claiming Southern Hospitality failed to pay back $50,000 from an agreement in November 2012.

The complaint also lists as a defendant Steve Cominsky, who was COO of Southern Hospitality Franchisee Holding Corp. when the restaurant opened in Denver in 2012. He now runs CC Management and Development Corp., a business consultant for restaurants.

That company took over management of Breckenridge Tap House in January after the restaurant shut down due to a salmonella outbreak in summer 2016. Cominsky did not respond to messages seeking comment.

Shamrock filed a similar suit seeking to collect on the $50,000 agreement on April 27. The complaint was dropped shortly after, with a notice saying the action may be dismissed upon payment of costs. Benjamin D. Vinci from Denver-based Vinci Law Offices represented Shamrock on both complaints.

Southern Hospitality’s landlord also is looking for restitution from the restaurant. Unico Bop St. Elmo LLC has filed a suit against Southern Hospitality Restaurant and its holding corporation, saying the restaurant broke its lease and failed to pay rent in June.

Southern Hospitality signed a 10-year lease for 7,500 square feet in the St. Elmo Hotel downtown in April 2012.

St. Elmo is suing for June’s rent, interest and late fees – an amount in excess of $200,000, according to the complaint. The suit also calls for compensation for the remainder of the lease. The suit was filed July 24 by Kimberly A. Bruetch and Chad M. McShane with Robinson Waters & O’Dorisio PC in Denver.
